Solon Police Shooting Under Review by County Prosecutor

Details of March 17 shooting have already been reviewed by the Ohio Attorney General's Office.

The Ohio Attorney General's Office has concluded its investigation of March's police-involved shooting in Solon and the findings will now be reviewed by the Cuyahoga County Prosecutor's Office. Prosecutor's Office Spokeswoman Maria Russo said in an email there is no timeline to release the findings. At about 9:45 p.m. on March 17, a police officer pulled over Kevin M. Bailey, 22, of Sylvania Township on Bainbridge Road. According to police, Bailey tried to escape from police and turned down Sunnywood Drive, where his car went over the curb and became damaged. Two police officers pursued, but before they could exit their cruisers, they came under gunfire. The police returned fire, killing Bailey. He was pronounced dead at the scene. One of …

County Prosecutor Candidates Talk Diversion, Overcharging

Over 750 people attended Greater Cleveland Congregations Forum

Fairmount Temple’s 750-seat congregation hall was filled to capacity at Monday’s Greater Cleveland Congregations’ forum for county prosecutor candidates. Congregants from 40 churches and synagogues gathered to see the five candidates answer to how they would support the organization’s priorities if elected. The GCC outlined four topics that they wanted candidates to address: preventing juveniles from waiving their right to an attorney, overcharging defendants with crimes, racial disparities in the justice system and adult and juvenile diversion programs. Four prewritten questions, found on the PDF to the right, each followed a personal story from a congregant about that issue’s impact on his or her life. One, a former alcoholic, told the …

GCC Prosecutor Forum: Subodh Chandra

Chandra responds to questions asked at GCC prosecutor candidate forum

SUBODH CHANDRA Chandra has worked as the Cleveland City Law Director and a federal prosecutor. He ran and lost in 2006 for Ohio Attorney General. On ensuring juveniles not waive their right to counsel without consulting an attorney: It’s even more important that this right be committed to juveniles [than to adults] because juveniles lack the capacity to make the appropriate decisions at that time so the notion that we have a lesser standard for juveniles is beyond outrageous. On overcharging: You’ve hit upon my very reason for running for this office … It will end. It must end. But it requires your next county prosecutor to not just be well intentioned but to come out of a culture where they don’t overcharge to turn the office around.  …

GCC Prosecutor Forum: Stephanie Hall

Hall answers the GCC's questions at Monday's candidate night

STEPHANIE HALL Stephanie Hall is a Cuyahoga County Assistant Prosecutor and former Cleveland police officer. On ensuring juveniles not waive their right to counsel without consulting an attorney: 2.7 million of our children’s adult parents are incarcerated so you are going to need in the court system an adequate representation to support those children when their parents are otherwise not in the home, so yes, I would support that and any other changes that would make the juvenile system more adequate and fair. On overcharging: I would definitely welcome the ACLU and the GCC to the table … I wanted to also get a collaborative effort with the prosecutors and the police officers [and enact training to prevent overcharging]. On racial …

GCC Prosecutor Forum: James McDonnell

McDonnell answered questions from the GCC Monday

JAMES MCDONNELL James McDonnell has served as the North Royalton City Prosecutor and an assistant prosecutor for Cuyahoga County. On ensuring juveniles not waive their right to counsel without consulting an attorney: They have to have lawyers. To think otherwise is crazy. On overcharging: When I’m elected county prosecutor, overcharging will end on that day because it must. We’ve never ever overcharged anyone when I was prosecutor in North Royalton. On racial disparities in incarcerated individuals: It absolutely exists. Three quarters of the people in the justice center where I am every single day for the last 30 years are African Americans yet I walked into drug court two or three weeks ago and 80 percent of the people were white. The …

GCC Prosecutor Forum: Tim McGinty

McGinty answers the GCC's questions at their forum Monday

TIM MCGINTY Tim McGinty has served as a Cuyahoga County Common Pleas judge and an assistant Cuyahoga County prosecutor. On ensuring juveniles not waive their right to counsel without consulting an attorney: For the past decade I might be one of Cuyahoga County’s most fierce advocates for early assignment of counsel … The fact that attorneys can present mitigation that often makes the case look different to police and the prosecutors is very important. It can make all the difference. Juveniles need good justice even more than adults. On overcharging: As prosecutor, I will not overcharge for plea leverage. I pledge to evaluate carefully before seeking indictment and charge only to the level the facts deserve. On racial disparity in …

GCC Prosecutor Forum: Robert Triozzi

Triozzi answers questions from the GCC at Monday's forum

ROBERT TRIOZZI Robert Triozzi has served as the Law Director for the City of Cleveland and a Cleveland Municipal Court judge. On ensuring juveniles not waive their right to counsel without consulting an attorney: The right to counsel is just so fundamental when you talk about a system that’s fair. You know, I’ve heard all the excuses – it costs too much or all the reasons why they think that the most vulnerable people in our community shouldn’t be afforded this basic right. It’s a false excuse. It’s a false explanation. This is money well spent. On overcharging:  Justice is not a game and you will never hear me as county prosecutor come and suggest to you that the conviction rate is a measure of what we do and is a measure of successes. …
