Bernie Kosar May Have Denied Breath Test to Help Court Case

The former QB may have dodged the most harmful evidence to his case by refusing test.

Former Cleveland Browns quarterback Bernie Kosar denied a breathalyzer test when he was pulled over for drunken driving in Solon on Sunday, Sept. 29.

By doing so, Kosar may have withheld a key piece of evidence in the case against his drunken driving charge, according to the Plain Dealer.

"If you don't have the test (a prosecutor) can't use it as evidence against you,"Β John Garmone, the deputy clerk for the Bedford Municipal Court, told the Plain Dealer. "They have to go more on the roadside sobriety tests."

Attorneys will advise clients to refuse the breathalyzer test taking away a scientific piece of evidence that can be very harmful to their case.

Kosar told police during his arrest that he was told never to take the breath test and also blamed his offensive line for injuries that would affect his performance on the field sobriety tests.

He is due in Bedford Municipal Court on Dec. 9.
